01 /Acceptance of terms
Please read these Terms of Service (“Terms”) carefully before using drchriscoleiam.com (the “Site”), operated by AI Collective IAM, LLC, a Wyoming limited liability company doing business as Dr. Chris Cole IAM (“AI Collective IAM,” “we,” “us,” or “our”). By accessing or using the Site, submitting information, registering for an event, or purchasing an offered program, you agree to be bound by these Terms. If you do not agree, do not use the Site or related services.
02 /Eligibility and U.S. audience
The Site and its offerings are intended primarily for persons located in the United States. They are primarily directed to adults, but participation is not categorically limited to individuals age 18 or older. If you are under the age of majority in your jurisdiction, you represent that you have your parent or legal guardian’s permission to use the Site or purchase/participate in an offering to the extent required by applicable law. We do not knowingly solicit or collect personal information from children under 13.
03 /Use of the Site
You agree to use the Site only for lawful purposes and in compliance with applicable law. You will not:
- Use the Site in a way that violates applicable laws, regulations, or the rights of others.
- Transmit unsolicited, deceptive, abusive, or unauthorized advertising or promotional material.
- Attempt to gain unauthorized access to the Site, its systems, accounts, or networks.
- Use bots, scrapers, crawlers, or other automated methods to access or collect Site data without prior written consent.
- Interfere with, disrupt, or compromise the Site’s integrity, security, or performance.
- Impersonate a person or entity or misrepresent your affiliation with any person or entity.
04 /Educational content and no advice
The Site may provide educational content, commentary, live classes, replays, webinars, trading-related materials, tools, algorithms, or programs. These materials are provided for general educational and informational purposes only. They are not individualized investment, financial, legal, tax, accounting, or other professional advice, and they do not create an adviser-client, fiduciary, or other professional relationship.
Markets and trading involve substantial risk. You are solely responsible for your own decisions, research, risk management, and actions. Past performance, examples, commentary, tools, algorithms, educational materials, testimonials, screenshots, or other performance-related content do not guarantee future results or outcomes.
05 /Programs, payments, and refunds
Programs may include intensives, live online classes, webinars, replays, educational materials, TradingView indicators or algorithms, and related offerings. Information about any offering is informational and is not a binding offer except where a separate purchase, enrollment, or program agreement expressly states otherwise. Availability, dates, access, pricing, payment plans, and program content may change. A submission of information, form, or inquiry does not guarantee access to any program.
Purchases may be processed by third-party payment providers, including FastPay Direct and Stripe. Their processing is subject to their own terms and privacy practices. All digital products and programs are non-refundable, including the Gold Futures Two-Week Intensive, unless a separate written agreement expressly states otherwise or a refund is required by applicable law. A payment is not a deposit unless an offer expressly says so.
06 /Session changes, cancellation, and replays
If Dr. Chris Cole cancels or reschedules a live session, we will provide notice by email to the email address associated with the participant’s registration or purchase. Replays are generally made available within 72 hours after each session for participants who miss a session, subject to technical availability and any program-specific access terms. We do not guarantee uninterrupted live delivery, replay availability, or access where a disruption is caused by factors outside our reasonable control.
07 /Gold Algo license and lifetime access
Where the Gold Algo is included with a program, we grant the purchaser a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Gold Algo solely for the purchaser’s own use, subject to these Terms and any stated program terms. “Lifetime access” means access for the operating life of the product, subject to these Terms, any permitted suspension or termination, and product availability.
You may not share, reshare, resell, transfer, sublicense, publish, reverse engineer, copy, modify, reproduce, distribute, or redistribute the Gold Algo, its access credentials, code, output, documentation, or related materials. We may retire, modify, replace, or discontinue the Gold Algo at any time without advance notice. No notice is required if the product is retired or materially changed.
08 /Testimonials, examples, and content permissions
We may use testimonials, feedback, screenshots, trade examples, and performance-related content that you provide to us or authorize us to use, subject to any separate written release or agreement. You should not assume that any testimonial, example, screenshot, or performance-related content is representative of typical results. Such material is not a promise or guarantee of any outcome.
09 /Access suspension, termination, and future purchases
We may suspend or terminate access to the Site, a program, the Gold Algo, replays, or other offerings, and may prohibit future purchases, if we reasonably believe you have violated these Terms; shared credentials or restricted materials; engaged in fraud, chargebacks, harassment, abuse, or misuse; infringed intellectual-property rights; or created a security, legal, or operational risk. Termination does not waive any payment, confidentiality, intellectual-property, indemnification, or other obligations that survive by their nature.
10 /Communications
If you opt in to receive email or SMS communications, you may receive messages regarding requested information, educational materials, program updates, and promotional offers. You may opt out of promotional emails through the unsubscribe link and opt out of text messages by replying STOP. Consent to communications is not a condition of purchase.
11 /Intellectual property
Unless otherwise stated, the Site and its content—including text, graphics, logos, images, videos, educational materials, algorithms, software, designs, and other materials—are owned by or licensed to AI Collective IAM, LLC and protected by applicable intellectual-property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site materials without prior written permission, except as permitted by law or an applicable written agreement.
12 /Third-party services and links
The Site may link to or integrate third-party websites and services, including forms, payment processors, webinar or video platforms, analytics tools, and social platforms. Those third parties operate under their own terms and privacy policies. We do not control and are not responsible for their content, availability, policies, or practices. Your use of third-party services is at your own risk.
13 /Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, CONTENT, ALGORITHMS, PROGRAMS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
14 /Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AI COLLECTIVE IAM, LLC, ITS DBA DR. CHRIS COLE IAM, AND THEIR OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, CONTENT, ALGORITHMS, PROGRAMS, OR SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF AI COLLECTIVE IAM, LLC AND ITS RELATED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY PROGRAM OR PRODUCT WILL NOT EXCEED US $100.00.
15 /Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless AI Collective IAM, LLC, its DBA Dr. Chris Cole IAM, and their owners, officers, employees, agents, contractors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party right.
16 /Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share personal information.
17 /Governing law and disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
18 /Changes, severability, and contact
We may update these Terms to reflect changes in the Site, programs, business practices, technology, or legal requirements. Posting an updated version on this Site is the intended notice method, and the revised “Last updated” date will identify when changes were made. If any provision is held invalid or unenforceable, that provision will be enforced to the fullest extent permitted and the remaining provisions will remain in effect.
